Attorneys for Amber Waterman are appealing the court's decision to move forward with two capital murder charges. Waterman is charged with the deaths of Ashley Bush and her unborn child after the mother was kidnapped in Benton County in 2022. The Missouri woman pleaded guilty in federal court in July to kidnapping resulting in death and causing the death of an unborn child. She was sentenced to life in prison on October 15th and booked into the Benton County Jail days later. Waterman pleaded not guilty on Monday to two charges of capital murder as the state pursues its case against her. The state's action, including seeking the death penalty, were on hold pending the conclusion of the federal case due to double jeopardy concerns. The judge ruled that double jeopardy doesn't apply to the capital murder charges but did dismiss the kidnapping charge. Her next hearing is in early April.
